SIMPLIHERE WASHINGTON CONSUMER HEALTH DATA PRIVACY NOTICE

SimpliHere, Inc (“SimpliHere,” “we,” “us,” “our”) is committed to protecting the privacy and security of information you provide us when visiting our website or using our mobile application (“App”) to facilitate communication between care recipients (“Care Recipients”) and caregivers (“Caregivers”) (each, a “User”) to manage caregiving needs.

This Washington Consumer Health Data Privacy Notice (“WA Privacy Notice) supplements the SimpliHere Privacy Notice available at https://simplihere.com/privacy-policy/. This WA Privacy Notice applies only to Washington consumers who interact with our website or App and applies only to personal information defined as “consumer health data” under the Washington My Health My Data Act.

For the purpose of this WA Privacy Notice, “consumer health data” means personal information about: 1) a Washington resident or that is collected in the state of Washington; and 2) that is linked or is reasonably linkable to a consumer and that identifies the consumer’s past, present or further physical or mental health status. Consumer health data may include:

  • Individual health conditions, treatments, diseases or diagnoses
  • Social, psychological, behavioral and medical interventions
  • Health-related surgeries or procedures
  • Use or purchase of prescribed medication
  • Bodily functions, vital signs, symptoms or measurements of information described as health status
  • Diagnoses or diagnostic testing, treatment or medication
  • Gender affirming care
  • Reproductive or sexual health information
  • Biometric data
  • Precise location information that could reasonably indicate a consumer’s attempt to acquire or receive health services or supplies
  • Data that identifies a consumer seeking health care services
  • Any information that is used to associate a consumer with information about health status and that is derived or extrapolated from non-health data.

This WA Privacy Notice describes the consumer health data we collect, how we use and disclose that data, how we protect it, and the choices you may have regarding our use or disclosure of your consumer health data.

This WA Privacy Notice does not apply to Protected Health Information (“PHI”) as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) that is contained in communications between you and a health care provider, health plan, or other payer, with whom we have entered into a HIPAA Business Associate Agreement.

 

CONSUMER HEALTH DATA WE COLLECT

If you use our App, whether as a Care Recipient or a Caregiver, you will be participating in a personal, private communication channel within the App on behalf of yourself and/or one or more persons within a care circle (“Care Circle”). We receive and store any consumer health data, as defined above, that you or members of your Care Circle provide.

This data may include information relating to the Care Recipient’s needs; actions taken; and updates that may be shared among and be available to Care Circle members. This data may also include precise

location of your device when the App is running in the foreground or background. Once a Care Circle is established, every member of that Care Circle is responsible for maintaining the confidentiality of the consumer health data shared in accordance with the Care Recipient’s and Users’ wishes.

We may also collect consumer health data that you or a Caregiver provide through our website in order to obtain information or support.

 

HOW WE USE CONSUMER HEALTH DATA

SimpliHere may use consumer health data that we collect for the following purposes:

  • To personalize and improve your experience on our website and App and to deliver the type of content and new offerings that may be of interest to you.
  • To contact you to respond to your requests or provide you with information that might be of interest, including information about products and services.
  • For analytical purposes and to research, develop and improve products, services and content.
  • To troubleshoot problems about the website and App.
  • For testing, research, analysis and product development related to our website and app.
  • To protect the safety and security of our workforce, guests, property and assets, including monitoring activities in facilities, devices, networks, communications and other resources.
  • As necessary or appropriate to protect against fraudulent, illegal or unethical activity.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • To comply with a law or regulation, court order or other legal, governmental or judicial process.
  • To perform the original purpose for which the consumer health data was collected.

 

HOW WE SHARE CONSUMER HEALTH DATA

We may share your consumer health data as follows:

  • With your consent;
  • With vendors we engage to provide services on our behalf, such as to deliver products or services to you; website hosting, email delivery, data analytics providers; or external consultants.
  • With our subsidiaries and affiliates;
  • In the event of a corporate sale, merger, acquisition, restructuring, reorganization, dissolution, or bankruptcy, or other change of ownership or control
  • To fulfill the purpose for which you provide it;
  • For any other purpose disclosed by us when you provide the consumer health data;
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce our rights arising from any contracts entered into between you and us, including the Terms of Use, and for billing and collection; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of SimpliHere, our customers, or others.
  • To respond to an emergency.
  • To your healthcare provider or insurance, healthcare plan or other payor if your use and access to the App is provided by such healthcare provider or payor.

SimpliHere does not sell or rent your consumer health data. In addition, SimpliHere does not share consumer health data contained in Care Circle interactions and communications among Care Circle users.

 

INDIVIDUAL RIGHTS

As a Washington consumer, you have the right to:

  • Request access to your consumer health data
  • Confirm whether we have disclosed or sold your consumer health data and to obtain a list of any recipients.
  • Delete your consumer health data
  • Withdraw your consent or authorization relating to your consumer health data.

In addition, if we deny your request, you may have the right to appeal.
